Terms of Use
Effective 6 November 2026
The short version
- Your notes belong to you. We don't claim any rights to them.
- You're responsible for the storage, AI services and backups you set up.
- The app is provided as is — keep backups of anything important.
1. Agreement
These terms apply to the Capable Notes desktop app and this website, provided by Capable Technologies (Pty) Ltd (“we”, “us”). By installing or using Capable Notes you agree to them. If you don't agree, please don't use the app.
2. Your content
You own everything you write, import or attach in Capable Notes. Your notes are stored in a folder you choose and, if you turn on sync, in storage you choose. We don't receive, host or claim any rights to your content.
3. Third-party services
Optional features connect to services you choose, such as Google Drive, Cloudflare R2, Anthropic's Claude, Ollama or AI apps connected over MCP. Your use of those services is governed by their own terms and privacy policies, and you are responsible for any accounts, API keys and costs involved. How the app handles data with these services is explained in our Privacy Policy.
4. AI features
AI output can be wrong or incomplete. Review AI suggestions and edits before relying on them. The app keeps every AI change in version history so you can undo it, and lets you choose how much access connected AI apps have.
5. Acceptable use
Don't use Capable Notes to break the law or to infringe anyone else's rights, and don't try to interfere with the services the app connects to. Don't remove notices from the app or redistribute modified copies presented as ours.
6. Backups and encryption
You are responsible for keeping backups of your notes. The app includes scheduled backups to help. If you turn on end-to-end encryption, only you hold the passphrase and recovery key — if you lose both, we cannot recover your encrypted data.
7. No warranty
Capable Notes is provided “as is” and “as available”, without warranties of any kind, to the extent permitted by law. We work hard to protect your notes — safe writes, conflict copies, version history and backups — but we can't promise the app will be error-free or uninterrupted.
8. Limitation of liability
To the extent permitted by law, Capable Technologies is not liable for any indirect or consequential loss, or for loss of data, arising from your use of the app. Nothing in these terms limits rights you have under the Consumer Protection Act or other laws that can't be excluded.
9. Changes
We may update these terms as the app evolves. We'll change the date at the top of this page, and mention significant changes in the app's release notes.
10. Governing law and contact
These terms are governed by the laws of the Republic of South Africa. Questions: hello@capabletech.net.
